DJ law

i have been dj'ing for almost 2 years . i know this doesnt't seem like a
long time but between this and my band i have been able to quit my job and
do this fulltime and support my family. but my questions are. i dj digitally
with a computer (in the united states) my songs are off cd's that i buy and
then put on the hard drive or download legally from the internet. i was at a
page called DJ Advantage and there forums say in the US it is totally
illegal to put your own cd's on your computer and use them. If this is so
why do most of the dj's i know do this and dont get caught and a few of the
clubs around here have there own computer platying mp3's. one is even hooked
to the internet and downnloads songs when they are requested and they dont
have them. maybe its cause i am from a relativly small town. sorry for the
long post but just wanted to clear a fewe things

Re: DJ law

I'm not a lawyer, so, I follow the rule of common sense. If I purchased the
intellectual property (Music), I feel that I have the right to make a back
up copy of it and utilize that copy. I'm not selling copies of copies nor,
am I profiting in any other way than if I utilized my originals. I would
challenge any Prosecutor to have me before a Jury of my peers with my
argument and try to get a conviction. The RIAA as circulated dozens of
rumors, most containing horror stories of raids in the middle of the night
by SWAT teams kicking down doors and confiscating computers and such. Music
and the distribution, marketing, and selling of it has changed. The RIAA
wants things to be the way they were in the "Glory Days" when a Hit song
could be imeshed with a bunch of "Kapok" on a CD thereby, forcing the
consumer to spend an unreasonable amount of money--$25.00 - $35.00 for a CD
that actually, cost about .60 cents to market and produce. Disrupt and
confuse the consumer with dis-information and you might very well stall the
inevitable changes.

Re: DJ law

Most music CD's are fall under the same type of copyright laws that govern
all intellectual property. It is illegal to use someone's work for public
performance without consent. I can only speak for Canada, but we require
AVLA licences, and the clubs are supposed to pay fees to SOCAN. My licence
covers all the vinyl I use, and my CD's are all from services that are
licensed by the AVLA. That being said, of the three clubs I work at, none
pay SOCAN fees. I have not been approached by anyone asking if I have the
proper licences, and neither have any of the DJ's that I know. I'm pretty
sure that no record label would take the time or effort to pursue legal
action against a DJ who is playing and promoting their artists
